Sprint Sand & Clay LLC alleges it is owed more than $20,000 for materials

GALVESTON – A construction materials supplier alleges it was not paid for supplies it sold for use in a League City project.

Sprint Sand & Clay LLC filed a complaint on Oct. 31 in the Galveston County District Court against SVO Construction Services Inc., Lawson L. Vander Vegte and Elite Vision Care PLLC citing breach of contract and other counts.

According to the complaint, the plaintiff alleges that plaintiff sold and delivered to defendant SVO labor, material, merchandise and/or services on credit and at a reasonable price. The suit states Vander Vegte guaranteed the SVO debt and that the materials were used on the Elite Vision Care property in League City.

After allowing for all offsets and credits, the suit states defendants are indebted to plaintiff in the sum of $22,980, plus interest and attorney's fees. The suit states the defendants have failed to pay this amount.

The plaintiff requests a trial by jury and seeks monetary relief of $100,000 or less and non-monetary relief. It is represented by Jacob D. Herberger and Sean M. Rooney of J D Herberger & Associates PC in Houston.
