HOUSTON – A Livingston man formerly employed by a trucking company alleges he was terminated for requesting a medical leave.
George Durden filed a complaint on Oct. 31 in the Houston Division of the Southern District of Texas against Altom Transport Inc. citing the Texas Commission on Human Rights Act, the Americans with Disabilities Act and the Family and Medical Leave Act.
According to the complaint, the plaintiff worked for the defendant as a dispatcher and terminal manager from June 2014 to November 2015. The suit states the plaintiff has long-standing circulatory problems and heart issues.
The plaintiff alleges that he was terminated in November 2015 after calling off work for heart issues and requesting an application for FMLA and short-term disability leave.
The plaintiff holds Altom Transport Inc. responsible because the defendant allegedly failed to provide reasonable accommodation, retaliated against him and terminated his employment for requesting FMLA leave for his serious health condition.
The plaintiff requests a trial by jury and seeks economic, compensatory and liquidated damages, court costs, attorney’s fees, pre- and post-judgment interest and such other and further relief.
