HOUSTON – A Spring man alleges an exhaust leak on his vehicle was not repaired in a good and workmanlike manner.
Matthew E. Mamo filed a complaint on Nov. 3 in the Harris County District Court against New Star Muffler Shop Corp., doing business as New Star Muffler Shop, alleging breach of contract and negligent misrepresentation.
According to the complaint, the plaintiff alleges that on June 26, he contracted defendant to perform repair work on his 2003 Gulfstream Sun Voyager's exhaust leak. The suit states on June 2, the vehicle was leased by Mamo and it failed in Ohio on July 12, which required towing fees and extensive repairs. The suit states the plaintiff was forced to cancel two booking/leases.
The plaintiff holds New Star Muffler Shop Corp. responsible because the defendant allegedly misrepresented the goods and services to be provided, improperly installed the same and failed and refused to correct the defective work.
The plaintiff seeks monetary relief of less than $100,000 and all other lawful and equitable relief. He is represented by Patrick M. Primavera of Primavera & Ghezzi PLLC in Magnolia.
