Former employee of Taqueria El Jimador Mexican Grill alleges he is owed overtime wages

HOUSTON – A former employee of a Mexican restaurant in Houston alleges that he was not paid the appropriate rate for overtime work.

Adonis Polanco filed a complaint on Nov. 6 in the Houston Division of the Southern District of Texas against Taqueria El Jimador Mexican Grill Inc. and Juan Flores alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed by the defendants as a cook's helper and regularly worked more than 50 hours a week. He alleges he was paid the same amount every week for all hours worked.

He alleges that he was financially damaged for not being paid at a rate of one-and-one-half times his regular hourly rate for all overtime hours.

The plaintiff seeks unpaid overtime wages, liquidated damages, pre- and post-judgment interest, attorneys’ fees, costs and expenses and such other and further relief. He is represented by Mark Siurek and Patricia Haylon of Warren & Siurek LLP in Houston.
