Galveston realty firm sues following man's refusal to convey property

GALVESTON – A local-based realty firm is suing a Humble man after he allegedly refused to convey his property to it, recent Galveston County court records indicate.

Save 1900 Realty, LLC initiated legal action against Donnail Biggers in the Galveston County Court at Law No. 3 on Nov. 17.

Court documents state that both parties entered into an agreement last month in which Biggers agreed to sell, and Save 1900 agreed to purchase, property located at 1213 36th St. in Galveston for $50,000. The closing was reportedly scheduled earlier this month.

According to the suit, Save 1900 appeared at the venue where the closing was to take place, but Biggers failed to show.

“Save 1900 was ready, willing, and able to purchase the property on the agreed date of closing,” the complaint says.

The plaintiff adds it contacted Biggers and demanded he immediately convey the subject property.

“The defendant has failed and refused, and continues to refuse to convey the property despite his obligation under the contract and subsequent demand letter,” the suit says.

Attorney John H. Campbell of Galveston is representing Save 1900.
