Terminix employee files class action seeking allegedly unpaid overtime wages

HOUSTON – An employee of a pest control company alleges he is owed unpaid overtime wages.

Jethro Cooper, individually and on behalf of all others similarly situated, filed a complaint on Dec. 4, 2017, in the Houston Division of the Southern District of Texas against Terminix International Co. LP and Terminix International Co. Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges in the last three years, he regularly worked more than 40 hours per workweek for the defendants without being paid time-and-a-half of his regular wage for overtime hours worked.

The plaintiff holds Terminix International Co. LP and Terminix International Co. Inc. responsible because the defendant allegedly paid plaintiff and the putative class members a salary and failed to compensate them for off-the-clock hours worked.

The plaintiff requests a trial by jury and seeks an order allowing this action to proceed as a class action, award for all unpaid overtime compensation, liquidated damages, attorneys' fees, costs and interest and such other relief to which plaintiff and the class members are justly entitled. He is represented by Taft L. Foley II of The Foley Law Firm in Houston.
