HOUSTON – Two consumers allege a debt collector has invaded their privacy with collection calls.

Jennifer Young and Christopher Lusk filed a complaint on Dec. 7, 2017, in the Houston Division of the Southern District of Texas against Medicredit Inc. alleging that the debt collection company violated the Telephone Protection Act and the Fair Debt Collection Practices Act.

According to the complaint, the plaintiffs allege they received collection calls from defendant on their cellphones without their prior express written consent and not for emergency purposes in 2016.

The plaintiffs hold Medicredit Inc. responsible because the defendant allegedly made unsolicited calls to their cellular telephones using an automatic telephone dialing system or pre-recorded voice and ignored their requests to stop calling.

The plaintiffs request a trial by jury and seek injunctive relief enjoining defendant from continuing to engage in unlawful calls, actual and statutory damages, attorneys’ fees, costs and any other relief deemed just and proper.

They are represented by W. Craft Hughes, Jarrett L. Ellzey and Deola T. Ali of Hughes Ellzey LLP in Houston and Bryant A. Fitts of Fitts Law Firm PLLC in Houston.
