Olive Garden guest alleges rocks caused her to fall, injure arm at restaurant

TYLER – A Kaufman County woman is seeking damages after a fall at a Tyler restaurant.

Treasure Matt filed a complaint on Dec. 22, 2017, in the Tyler Division of the Eastern District of Texas against Darden Restaurants Inc., doing business as Olive Garden, alleging premises liability.

According to the complaint, the plaintiff alleges that on Nov. 5, 2016, she was a guest at defendant's premises in Tyler when her foot caught the uneven rocks lining the sidewalk, causing her to fall and injure her arm.

The plaintiff holds Darden Restaurants Inc. responsible because the defendant allegedly failed to reasonably inspect the property and failed to cure or warn the plaintiff of the condition.

The plaintiff seeks actual damages within the jurisdictional limits of the court, pre- and post-judgment interest, costs of court and such other just and proper relief. She is represented by Micah L. Satterwhite of Sloan, Hatcher, Perry, Runge, Robertson & Smith in Longview.
