HOUSTON – A lathe machinist alleges his Houston employer failed to pay him the correct rate for overtime work.
Jose Rodriguez, individually and on behalf of all others similarly situated, filed a complaint on Jan. 9 in the Houston Division of the Southern District of Texas against Logik Precision Inc. & Water Jet Division alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff was hired by the defendant in October 2015. He alleges he was paid at an hourly rate but was not compensated for any hours worked over 40 per week.
The plaintiff holds Logik Precision Inc. & Water Jet Division responsible because the defendant allegedly failed to pay him at a rate of time-and-one-half his regular rate of pay for overtime work.
The plaintiff seeks an order allowing this action to proceed as a collective action, award for all unpaid overtime wages, liquidated damages, attorneys’ fees and costs, post-judgment interest and any further relief that plaintiff and the class members are justly entitled.
