BFI Waste Services of Texas LP employee alleges he forced to drive unsafe truck

HOUSTON – A Nueces County man claims he was injured while working at a landfill when the truck he was driving rolled over.

Anthony Powell filed a complaint on Jan. 10 in the Harris County District Court against BFI Waste Services of Texas LP, doing business as Allied Waste Services, alleging negligence.

According to the complaint, the plaintiff alleges that on July 29, 2016, he was working for the defendant at its Cefe Valenzuela landfill. He alleges he was instructed to drive a truck that was known to be mechanically unsafe and was told if he refused to drive it, he would be terminated. He alleges while driving the truck, it experienced mechanical failure and rolled over on its side and injured him.

The plaintiff holds BFI Waste Services of Texas LP responsible because the defendant allegedly failed to provide safe equipment and willfully forced him to drive a vehicle it knew to be unsafe.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but not more than $1 million and such other just and proper relief. He is represented by Michael E. Pierce and James P. Lamey of Pierce Skrabanek PLLC in Houston.
