Shopper brings slip and fall case against Albertsons, Aramark

TEXARKANA – A Bowie County woman’s trip to an Albertsons in the city in late 2015 resulted in a slip and fall lawsuit.

Lynn Martina filed the suit against Albertsons LLC and Aramark Uniform & Career Apparel, LLC in Bowie County District Court on Dec. 13, 2017. The litigation was elevated to federal court on Jan. 18.

Martina claims she tripped over a rug “that was improperly and dangerously hidden partially underneath a display.” The rug was reportedly under the care of Aramark.

“The rug was folded or rolled and not flat on the floor, causing an unreasonable tripping hazard,” court documents state.

The complaint adds the incident caused the plaintiff to hit her face on a display for Little Debbie’s snack cakes, as well as hit her head on the concrete floor and be knocked unconscious.

“The fall injured Ms. Martina’s ankle, knee, face, and head,” the original petition says. “She was transported by ambulance to the hospital.”

Martina asserts she has experienced headaches and memory loss following the event in question.

Both defendants formally deny Martina’s allegations.

The complainant consequently seeks unspecified monetary damages and a jury trial.

She is represented by Jonathan W. Beck of the law firm Dunn, Nutter & Morgan, L.L.P. in Texarkana. Timothy U. Stanford of Downs Stanford P.C. in Dallas is representing Aramark while O. Paul Dunagan of Sarles & Ouimet, also in Dallas, serves as the counsel for Albertsons.
