TEXARKANA – A railroad worker alleges he was injured when the cars of ties he was riding struck a work train in Mount Pleasant.
Rodney E. Crossley filed a complaint on Jan. 18 in the Texarkana Division of the Eastern District of Texas against Union Pacific Railroad Co. alleging that the interstate carrier violated the Federal Employers' Liability Act.
According to the complaint, the plaintiff alleges that on Jan. 2, 2017, he was working in the course and scope of his employment with defendant when train cars collided with the east end of a work train in Mount Pleasant. The plaintiff alleges he was riding the ladder on one of 14 cars of ties being pushed by a Brandt truck at the time of the incident.
As a result of the violent impact and severe jerking, he alleges he sustained injuries to his neck, hips and knees and was caused to suffer medical treatment expenses, pain and suffering, mental anguish, disfigurement and lost wages and benefits.
The plaintiff holds Union Pacific Railroad Co. responsible because the defendant allegedly negligently directed a co-worker to handle 14 cars of ties in violation of operating rules, failed to provide adequate lighting and failed to have job briefing at the road crossing.
The plaintiff seeks actual damages, post-judgment interest, court costs and such other relief to which he is entitled. He is represented by Marc A. Zito of Jones Granger Law Firm in Houston.
