HOUSTON – The children of a woman killed in a single-vehicle auto accident in Brazos County allege the truck she was driving was not crashworthy.
Gary Garcia, Jennifer Grodewald, Jordan Seymore and Olivia Cureton filed a complaint on Jan. 18 in the Houston Division of the Southern District of Texas against Ford Motor Co. alleging that the automobile manufacturer failed to comply with the Federal Motor Vehicle Safety Standards.
According to the complaint, the plaintiffs allege that on Jan. 15, 2017, plaintiffs' mother Renee Garcia was operating a 2007 Ford F150 traveling on state Highway 47 in Brazos County when she lost control of the vehicle, causing it to travel off the overpass and land onto state Highway 21. Despite properly wearing the three-point seat belt, Renee Garcia sustained fatal injuries, the suit states.
The plaintiffs hold Ford Motor Co. responsible because the defendant allegedly failed to manufacture a crashworthy vehicle that can maintain survival space and provide proper protection throughout the entire accident.
The plaintiffs seek actual, economic and non-economic damages, pre- and post-judgment interest, costs of suit and all other general and special relief. She is represented by E. Todd Tracy, Stewart D. Matthews and Andrew G. Counts of The Tracy Firm in Dallas.
