HOUSTON – A shopper at the Marshall's store at the First Colony Mall in Houston alleges she fell in the store because of merchandise on the floor.
Martha Tillman filed a complaint on Jan. 18 in the Harris County District Court against The TJX Cos. Inc. alleging premises liability.
According to the complaint, the plaintiff alleges that on Dec. 21, 2017, she was an invitee at defendant's Marshall's department store when she slipped and fell on a coat on the floor. She alleges she sustained numerous and serious injuries that resulted in medical expenses, pain and suffering, mental anguish and lost wages.
The plaintiff holds The TJX Cos. Inc. responsible because despite defendant's employees' alleged awareness of the dangerous condition, they purportedly failed to make it safe nor warned their invitees that such a condition existed.
The plaintiff seeks monetary relief of less than $100,000 and such other legal and equitable relief to which she may be entitled. She is represented by David K. Mestemaker, Norman Straub, Van Gardner and Jonathan B. Zumwalt of Mestemaker & Straub in Houston.
