Consumer alleges Real Page-issued consumer report falsely listed criminal history

SHERMAN – A Nevada man alleges his application for housing in Florida was denied because of false information provided on a consumer report.

Julian Smith filed a complaint on Jan. 9 in the Sherman District of the Eastern District of Texas against Real Page Inc. alleging violation of the Fair Credit Reporting Act.

According to the complaint, the plaintiff alleges that on July 3, 2015, he applied for housing at South Gate Towers in Miami, Florida. The suit states the defendant prepared his consumer report as part of the application process and that the report contained inaccurate information. He alleges the report falsely stated he was female and had a criminal history.

As a result of defendant's alleged acts, he claims his application was denied by South Gate. 

The plaintiff holds Real Page Inc. responsible because the defendant allegedly didn't reinvestigate or delete the false information after the plaintiff contacted it for a dispute.

The plaintiff seeks actual, statutory and punitive damages, costs and attorney fees. He is represented by Micah S. Adkins of The Adkins Firm PC in Brentwood, Tennessee.
