P&D Restaurant & Wine Bar alleges individuals converted property for their own use

HOUSTON – A limited partnership is seeking a temporary restraining order against a Houston couple.

P&D Restaurant & Wine Bar LTD filed a complaint on Jan. 22 in the Harris County District Court against Phillip and Kim Mitchell alleging that they violated the Texas Theft Liability Act and other counts.

According to the complaint, the plaintiff was organized in early 2017 to operate a new restaurant and wine bar and the defendants were to execute the formation documents and undertake to perform their tasks and work. 

The plaintiff holds Phillip and Kim Mitchell responsible because Phillip Mitchell allegedly isolated himself in control of the restaurant, attempted to take control of the credit card processing machines and changed the locks and the defendants allegedly converted its property for their own use.

The plaintiff requests a trial by jury seeks to recover all sums and materials taken by the defendants, an order for defendants to stay more than 200 feet away from plaintiff's property, award for all damages, attorney's fees, costs, interest and all other lawful and equitable relief. It is represented by Anthony L. Laporte of Hanszen Laporte in Houston.
