IHOP employee alleges she is owed unpaid minimum, overtime wages

SHERMAN – An employee of the nation's largest IHOP franchise alleges she and other workers are owed unpaid wages.

Lourie Chancellor, individually and on behalf of all others similarly situated, filed a complaint on Jan. 23 in the Sherman Division of the Eastern District of Texas against ACG Texas LP alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed at the defendant's IHOP restaurant in Frisco in a wait staff position.

The plaintiff holds ACG Texas LP responsible because the defendant allegedly required its employees to perform non-tip-producing duties while compensating them at the lower $2.13 tipped rate. She also alleges she was not paid a minimum wage or an overtime rate.

The plaintiff requests a trial by jury and seeks an order recognizing the proceeding as a collective action, payment for all unpaid wages and overtime compensations, punitive damages, attorney’s fees, expert fees, costs and expenses and all other relief as to which plaintiff may be entitled.
