HOUSTON – Former employees of a railroad switching provider allege that they are owed unpaid overtime wages.
Daniel Gonzalez, Jose Gonzalez, et al. filed a complaint on Jan. 26 in the Houston Division of the Southern District of Texas against Rescar Cos. alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiffs allege they routinely worked more than 40 hours per week during their employment with the defendant but were only paid their regular hourly rate.
The plaintiffs holds Rescar Cos. responsible because the defendant allegedly failed to compensate them for their overtime hours at a rate of one-and-one-half times their hourly rate as required by the FLSA.
The plaintiffs request a trial by jury and seek all unpaid overtime compensation, liquidated damages, attorneys’ fees, and costs, post-judgment interest and such other and further relief that plaintiffs are justly entitled.
