Nursing student claims community college denied her access to remediation plan after unsuccessful attempts at exit exam

HOUSTON – A woman who studied nursing at Houston Community College claims the school refused to let her take advantage of a mandated remediation plan after she failed the Health Education Systems, Inc. exam.

Samantha Washington filed a lawsuit against HCC on Jan. 28 in the Harris County 11th District Court, stating the defendant’s supposed actions ultimately resulted in her dismissal from the nursing program and failed re-admission attempt.

Washington explains passage of the exam is a requirement for graduation from the Associate Nursing Degree Program. The suit adds HCC permits students to take the exam twice, of which remediation is mandatory in between both opportunities.

According to Washington, the respondent deprived her of assistance despite its policy. She asserts she eventually accessed her HESI plan, but had little time to prepare afterwards.

The college reportedly permitted other students in the same predicament as Washington to use their remediation plans in a timely manner.

“The plaintiff has been injured as a result of the conduct of HCC,” the complaint states.

Consequently, Washington seeks $200,000 in damages.

She is represented by Mandy R. Jones of the Law Office of Mandy R. Jones in Houston.
