HOUSTON – A Harris County woman alleges a negligent Home Depot employee struck her with a lawnmower while she was walking in the parking lot.
Julia Moreno and Rosa Alas filed a complaint on Jan. 31 in the Harris County District Court against Home Depot USA Inc. and Roy Hoeser alleging negligence.
According to the complaint, the plaintiffs allege that on July 16, 2016, Moreno and Alas were attempting to enter the Home Depot building through the parking lot when Hoeser recklessly and negligently drove a lawnmower-tractor into plaintiff Moreno, knocking her down and dragging her several feet away from the point of impact. Moreno alleges she suffered substantial injuries and damages while plaintiff Alas alleges she suffered mental anguish and emotional trauma from witnessing the incident.
The plaintiffs hold Home Depot USA Inc. and Hoeser responsible because defendant Hoeser allegedly failed to maintain proper lookout and maintain a proper speed while operating the lawnmower and failed to take proper evasive maneuvers to avoid the incident.
The plaintiffs request a trial by jury and seek monetary relief of more than $200,000 but not more than $1 million and such other relief to which they are entitled. They are represented by Brant J. Stogner of Abraham, Watkins, Nichols, Sorrels, Agosto & Aziz in Houston.
