West Colombia man seeks more than $1 million after allegedly falling on rebar wiring at refinery

HOUSTON – A West Colombia couple is seeking more than $1 million after the husband was injured at a Longview refinery because of alleged negligence.

William T. Gardner and Linda Gardner filed a complaint on Jan. 31 in the Harris County District Court against Westlake Chemical Corp. and Eastman Chemical Co. alleging negligence and other counts.

According to the complaint, the plaintiffs allege that on Feb. 19, 2016, plaintiff William Gardner was delivering purified oil to a Longview refinery owned by Eastman and operated by Westlake. He alleges that during the delivery, he tripped on a stack or pad of rebar in the road, causing him to fall on the rebar wiring. He alleges he sustained injuries that resulted in pain and suffering, disfigurement, loss of earning capacity and medical expenses. 

The plaintiffs hold Westlake Chemical Corp. and Eastman Chemical Co. responsible because the defendants allegedly negligently allowed a pad of rebar to sit on the road where William Gardner was directed to work and failed to warn him of the potential hazard caused by the placement of the rebar pad.

The plaintiffs seek a sum of more than $1 million and such other legal and equitable relief. They are represented by Seth Mitchell Park and Alton C. Todd of The Law Firm of Alton C. Todd in Friendswood.
