HOUSTON – A Louisiana man is seeking damages after he was injured while working on a vessel.
Allen Smith Jr. filed a complaint on Feb. 2 in the Harris County District Court against Offshore Specialty Fabricators LLC alleging unseaworthiness.
According to the complaint, the plaintiff alleges that on June 30, 2016, he was injured while performing his duties on the defendant's Swing Thompson vessel when he fell down the stairs. He alleges he sustained severe and disabling injuries and was caused to suffer lost earnings, mental anguish, pain and suffering, medical expenses and physical impairment.
The plaintiff holds Offshore Specialty Fabricators LLC responsible because the defendant allegedly failed to take reasonable precautions for the plaintiff's safety and failed to maintain the vessel in a safe and reasonable state of repair.
The plaintiff seeks actual and exemplary damages, pre- and post-judgment interest, costs of court, attorney's fees and all other relief to which he is entitled. He is represented by Marcus R. Spagnoletti of Spagnoletti & Co. in Houston.
