Mi Tienda shopper seeks more than $200,000 after falling in Houston store

HOUSTON – A customer at a Harris County grocery store alleges she fell because of a substance on the floor.

Ma Antonia Hernandez Torres filed a complaint on Feb. 6 in the Harris County District Court against Juan Daniel Garcia, doing business as Mi Tienda No. 2 Store No. 648, and HEB Grocery Co. LP alleging negligence.

According to the complaint, the plaintiff alleges that on March 9, 2016, she was injured at defendant's Mi Tienda grocery store at 3800 Little York Road in Houston when she slipped and fell on a slippery substance on the floor. 

The plaintiff holds Garcia, doing business as Mi Tienda No. 2 Store No. 648, and HEB Grocery Co. LP responsible because the defendants allegedly failed to exercise reasonable care to reduce or eliminate the risk of danger and failed to warn their customers that a dangerous condition existed in the premises.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but not more than $1 million and such other relief to which she may show herself justly entitled. She is represented by Nicole M. Nech of The Nech Law Firm PC in Houston.
