Former delivery driver alleges Domino’s Pizza operator owes unpaid wages

TEXARKANA – A former delivery driver for a Mount Pleasant pizza chain alleges he and other drivers are owed unpaid wages.

Bruce Gentry, individually and on behalf of all others similarly situated, filed a complaint on Feb. 7 in the Texarkana Division of the Eastern District of Texas against EPSI Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, the defendant operates 27 Domino's Pizza franchises in Texas and one in Arkansas. The plaintiff alleges that he was employed by the defendant from September 2015 and October 2017 as a delivery driver.

The plaintiff holds EPSI Inc. responsible because the defendant allegedly systematically failed to adequately reimburse its delivery drivers for the reasonable costs of their delivery expenses and did not pay delivery drivers the full minimum wage for the time they spent doing nontipped work.

The plaintiff requests a trial by jury and seeks compensatory and liquidated damages, pre- and post-judgment interest, attorneys’ fees and costs and such other fair and equitable relief.
