HOUSTON – A woman alleges she worked more than 40 hours per week at a Conroe location and was not paid the appropriate rate for overtime work.
Kelly Miciak, individually and on behalf of all others similarly situated, filed a complaint on Feb. 9 in the Houston Division of the Southern District of Texas against Aries Worldwide Logistics LLC alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff worked at the defendant's Conroe facility as a global service center agent from June 2014 to November 2017.
The plaintiff holds Aries Worldwide Logistics LLC responsible because the defendant allegedly paid its service agents a regular salary with no overtime pay for hours worked over 40 per workweek.
The plaintiff seeks unpaid minimum wages and overtime pay, liquidated damages, attorneys’ fees, costs and expenses, post-judgment interest and such other lawful relief. The plaintiff is represented by David I. Moulton and Matthew S. Parmet of Bruckner Burch PLLC in Houston.
