Laborer alleges A.B. General Construction and Repairs owes unpaid wages

HOUSTON – A Houston man alleges he is owed unpaid overtime wages from his former construction company employers.

Victor Lopez, individually and on behalf of all others similarly situated, filed a complaint on Feb. 9 in the Houston Division of the Southern District of Texas against A.B. General Construction and Repairs LLC and JEM Construction Group LLC alleging violation the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed by the defendants as a laborer from 2013 to November 2017, with one year off in 2015. He alleges he worked more than 40 hours per workweek.

The plaintiff holds A.B. General Construction and Repairs LLC and JEM Construction Group LLC responsible because the defendants allegedly failed to maintain accurate time and pay records and refused to compensate employees for their employment in excess of 40 hours per workweek at a rate of no less than one-and-one-half times their regular rate.

The plaintiff requests a trial by jury and seeks an order allowing this action to proceed as a collective action, an award for all unpaid overtime wages, liquidated damages, attorneys’ fees, costs and all such other and further relief. He is represented by Melissa Moore, Curt Hesse and Bridget Davidson of Moore & Associates in Houston.
