Union Pacific Railroad Co. machinist alleges he was injured because of unsafe work environment

HOUSTON – A machinist alleges he was injured while working on a locomotive in a rail yard.

Tilman Bailey filed a complaint on Feb. 9 in the Harris County District Court against Union Pacific Railroad Co. citing the Federal Employers' Liability Act and other counts.

According to the complaint, the plaintiff alleges that on March 3, 2015, he was injured while in the course and scope of his employment with the defendant while performing inspection on locomotive 9781. 

He alleges he sustained serious and permanent injuries to his spine, back, arm, shoulder and rotator cuff and has suffered diminished earning capacity, medical expenses and loss of household service. 

The plaintiff holds Union Pacific Railroad Co. responsible because the defendant allegedly failed to provide a safe place to work and failed to install or maintain a proper derail device on the tracks to prevent a collision.

The plaintiff requests a trial by jury and seeks damages for the injuries and damages he suffered, together with interest, costs and all other lawful relief. He is represented by John D. Roven of Roven Law Group PC in Houston and Jeffrey Chod of Chod Law LLC in Denver, Colorado.
