Former construction foreman for Midway Oilfield Constructors Inc. alleges he is owed unpaid wages

HOUSTON – A Cuero man alleges a Madison County business failed to pay him overtime wages.

Braxton Nesloney filed a complaint on Feb. 12 in the Houston Division of the Southern District of Texas against Midway Oilfield Constructors Inc. and Billy A. Smith alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between March 2017 and Jan. 12, 2018, he worked for defendant as a construction foreman. He alleges he worked more than 40 hours per week during his employment.

The plaintiff holds Midway Oilfield Constructors Inc. and Smith responsible because the defendants allegedly failed to comply with the overtime provision of the FLSA and instead paid him a weekly salary of $1,700 regardless of the number of hours he worked.

The plaintiff requests a trial by jury and seeks damages for unpaid wages, liquidated damages, injunctive relief, declaratory relief, attorney’s fee, costs and such other lawful and equitable relief. He is represented by Charles L. Scalise and Daniel B. Ross of Ross Law Group in Austin.
