Former employee alleges Cobra EMS Inc. failed to pay the correct rate for overtime work

HOUSTON – A Crosby individual previously employed as an emergency medical technician alleges her former employers owe her unpaid wages.

Sabrina Hatfield, individually and on behalf of all others similarly situated, filed a complaint on Feb. 13 in the Houston Division of the Southern District of Texas against Cobra EMS Inc., Antoine Joseph and Alvin Breaux alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between March 13 and Sept. 6, 2017, she regularly worked in excess of 40 hours per week for defendants without receiving any overtime premium for her overtime work. 

The plaintiff holds Cobra EMS Inc., Joseph and Breaux responsible because the defendants allegedly failed to compensate their employees at a rate no less than one-and-one-half times their regular rates of pay for each hour worked in excess of 40 in a workweek.

The plaintiff requests a trial by jury and seeks an order declaring this action as a collective action, award for all unpaid wages, liquidated damages, injunctive and declaratory relief, attorney’s fee and costs and such other and further relief. She is represented by Charles L. Scalise and Daniel B. Ross of Ross Law Group in Austin.
