Laid off Success Partners Holding Co. employee alleges he was not given notice

SHERMAN – An IT infrastructure manager for a Plano facility alleges he was terminated in a mass layoff without cause.

James Hemenway, individually and on behalf of all others similarly situated, filed a complaint on Feb. 14 in the Sherman District of the Eastern District of Texas against Success Partners Holding Co. alleging that the former employer violated the Worker Adjustment Retraining Notification Act.

According to the complaint, the plaintiff alleges that on Jan. 15, 2018, he and other employees were terminated from their employment without cause. 

The plaintiff holds Success Partners Holding Co. responsible because the defendant allegedly terminated his employment without providing a 60-day advance written notice required by WARN and without offering him back wages and benefits to which he is entitled.

The plaintiff requests a trial by jury and seeks an order certifying this action as a class action, designating him as class representative and his counsel as class counsel, judgment in his favor for all unpaid wages and other benefits, and such other just and proper relief.
