BROWNSVILLE – A Houston consumer alleges a New Jersey company ignored her requests to stop calling her.

Josie Rogers filed a complaint on Feb. 16 in the U.S. District Court for the Southern District of Texas against Quest Diagnostics Inc. alleging that the telemarketer violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that between December 2016 and April 2017, she received numerous calls to her cellular telephone from defendant without her prior express consent. She alleges she revoked her content to be contacted in December 2016 but the request was ignored.

The plaintiff holds Quest Diagnostics Inc. responsible because the defendant allegedly ignored her request to cease calling her and continued to make calls using an automatic telephone dialing system and/or pre-recorded voice.

The plaintiff requests a trial by jury and seeks actual damages, statutory damages of $500 and treble damages of $1,500 for every violation of the act and such other appropriate relief. She is represented by Amy L. Bennecoff Ginsburg of Kimmel & Silverman PC in Ambler, Pennsylvania.
