Former Gordon Food Service employee seeks judgment regarding severance

HOUSTON – A Montgomery County man alleges he was not provided severance benefits as outlined in his employment agreement.

John Miller filed a complaint on Feb. 19 in the Harris County District Court against Gordon Food Service Inc. seeking declaratory judgment and injunctive relief.

According to the complaint, the plaintiff entered into an employment agreement with the defendant in June 2011. He alleges that as a result of his involuntary termination on Feb. 2, 2018, he is entitled to receive his salary until May 31, 2018, plus an additional 12 months' salary for the then-current fiscal year. 

The plaintiff holds Gordon Food Service Inc. responsible because the defendant allegedly breached the portion of the employment agreement and did not provide the severance benefits.

The plaintiff requests a trial by jury and seeks an order declaring that the non-competitive provisions the defendant is attempting to enforce are unenforceable, damages in excess of the minimum jurisdictional limits of the court, attorney's fees, costs and such other relief to which he is entitled. He is represented by Greg M. Rosenberg of Rosenberg Sprovach in Houston.
