Injured motorist files suit against Tracey & Fox law firm over fraud allegations

HOUSTON – An Ingleside man has filed a suit against a law firm over its alleged handling of a settlement in his lawsuit.

William Knight filed a complaint on Feb. 20 in the Harris County District Court against Lance N. Walters, Tracey & Fox and Michael P. Fleming alleging that they violated the Texas Deceptive Trade Practices Act, common law fraud and other counts.

According to the complaint, the plaintiff was involved in a collision with a drunk driver in March 2014 and received medical treatment. The suit states the hospital where he received treatment filed a lien for $21,259 and the plaintiff hired the defendants in July 2014 to represent him to recover financial compensation for his injuries.

The suit states the plaintiff settled with the driver's insurance carrier for $30,000 and the defendants filed a claim for uninsured/underinsured motorist insurance with plaintiff's insurer. The plaintiff alleges his insurer settled for $50,000 but the defendants have refused to distribute and pay plaintiff the amount.

The plaintiff holds Lance N. Walters, Tracey & Fox and Michael P. Fleming responsible because the defendants allegedly failed to pay the plaintiff's hospital bill and failed to disclose facts to the plaintiff about their representation and handling of his claims.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but not more than $1 million and such other general and special relief. He is represented by Richard S. Joseph Jr. in Lakeway.
