Widower says HHS erroneously listed late wife as single on death certificate

HOUSTON – A Harris County man claims the Texas Health and Human Services Commission refuses to let him correct a mistake on his late wife’s death certificate.

Minh Quang Thieu filed a lawsuit against HHS on Feb. 23 in the Harris County 125th District Court, alleging the agency erroneously listed Lorraine Lynette Diaz’s marital status as single.

According to Thieu, he and the decedent were legally married in the county on Feb. 16, 2015.

Diaz died from an apparent homicide on Jan. 11, 2017.

Recent court documents state that Thieu was cleared of any involvement, and the Fort Bend County Clerk verified and certified Diaz’s death on Mar. 3, 2017.

The suit says the couple was still married and was never divorced at the time of Diaz’s passing.

Per Thieu, the defendant continuously denied him the opportunity to amend the death certificate.

Consequently, he seeks unspecified monetary damages.
