Ace Hardware customer alleges forklift injured hand

GALVESTON – A customer of a Friendswood hardware store alleges his hand was injured by a forklift while shopping.

Carter Winston Goyen filed a complaint on Feb. 26 in the Galveston County District Court against Magnuson Hardware GP LLC and Ace Hardware Corp. alleging negligence.

According to the complaint, the plaintiff alleges that on April 28, 2017, he was injured at defendants' business premises in Friendswood when defendants' staff caused a forklift to collide into his finger and hand. 

The plaintiff holds Magnuson Hardware GP LLC and Ace Hardware Corp. responsible because defendants' employee allegedly failed to operate the forklift in a safe manner and failed to maintain a proper lookout.

The plaintiff seeks monetary relief of more than $100,000 but not more than $1 million and such other lawful and equitable relief. He is represented by Matthew C. Stano of The Stano Law Firm in Humble and Timothy M. Clark of Timothy M. Clark & Associates PLLC in Santa Fe.
