MARSHALL – Two individuals are seeking damages from several motorists after their vehicle was struck on an interstate in Gregg County.
Clyde Bennett Jr. and Wilburn Charles Bennett filed a complaint on Feb. 27 in the Marshall Division of the Eastern District of Texas against T-N-T Trucking of Pioneer Louisiana LLC, Ronald Dyes II, Steven G. McCarter and Walter E. Pearce alleging negligence.
According to the complaint, the plaintiffs allege that on Dec. 20, 2017, they were injured in an automobile accident on Interstate 20 when defendant Dyes, who was driving a Freightliner truck and towing a trailer owned by defendant T-N-T, struck the vehicles driven by defendants McCarter and Pearce, causing the Pearce vehicle to strike the rear of plaintiffs’ vehicle.
The plaintiffs hold T-N-T Trucking of Pioneer Louisiana LLC, Dyes II, McCarter and Pearce responsible because defendants Dyes, McCarter and Pearce allegedly failed to keep a proper look out, failed to timely apply brakes and failed to control their vehicles.
The plaintiffs request a trial by jury and seek punitive damages, post-judgment interest, costs, fees and other expenses and any further relief to which they may be entitled. They are represented by Brent Goudarzi and Marty Young of Goudarzi & Young LLP in Gilmer.
