Mental health center alleges insurer misrepresented about flood coverage

HOUSTON – A local mental health facility has sued its insurer and the company’s executive vice president for allegedly misrepresenting about its flood coverage, recent Harris County District Court records indicate.

In a lawsuit filed on Feb. 23 in the Harris County 80th District Court, the Harris Center for Mental Health and IDD explains that Higginbotham Insurance Agency, Inc. and Paige M. Cokinos wrongly divulged that its office at 7200 N. Loop was covered against floods through the Texas Council Risk Management Fund.

Hurricane Harvey struck the Upper Texas Gulf Coast in late August and inundated the region with approximately 50 inches of water. The plaintiff’s property reportedly sustained flood damage, to which the suit claims the defendants failed and refused to cover.

According to the original petition, the Harris Center later learned that its facility was ineligible for flood coverage since it was located in a FEMA-designated flood zone labeled “AE,” or high risk.

The complainant asserts it suffered “massive uninsured” losses of at least $400,000.

Consequently, it seeks unspecified monetary damages and a jury trial.
