Boilermaker files lawsuit in response to head injury

HOUSTON – A purported industrial accident in New Mexico is the subject of a Missouri man’s lawsuit.

Harwood, Mo., resident Chris M. McAfee filed the suit against Brock Holdings III, Inc.; Brock Services, LLC; Brock Industrial Services, LLC; and Western Refining, Inc. on Mar. 2 in the Harris County 165th District Court.

McAfee, a boilermaker, alleges he was installing perimeter blinds at the Western Refining facility in Gallup, N.M. on Apr. 19, 2017 when he was struck in the head by a falling scaffold bar.

Recent court papers assert the object fell from a scaffold deck erected and staffed by the Brock defendants.

“The defendants had no warning signs or barriers in place alerting the plaintiff of potentially falling objects from above,” the suit says.

Consequently, the complainant seeks unspecified monetary damages and a jury trial.
