Sullivan Newport alleges Flatboat I failed to pay for lease of slip space

GALVESTON – The owner of a dry dock is alleged to have failed to pay for space it leased in Galveston.

Sullivan Newport LTD filed a complaint on Feb. 28 in the Galveston County District Court against Flatboat I LLC and Jeff Henry alleging breach of contract.

According to the complaint, the plaintiff owns wharves and seabed in Galveston and in early 2015, it was approached by the defendants' representatives regarding the lease of slip space. The plaintiff alleges this negotiation never went further than the discussion stage.

The suit states on April 25, 2015, the defendants towed the dry dock to plaintiff’s premises, showing up unannounced. The plaintiff alleges it orally agreed to lease the space for $5,250 a week for 30 days.

The plaintiff holds Flatboat I LLC and Henry responsible because the defendants allegedly failed and refused to pay rent, refused to move the dry dock and failed to maintain it, allowing it to rust and sink at its mooring.

The plaintiff requests a trial by jury and seeks monetary relief of more than $1 million and such other and further relief to which plaintiff is justly entitled. It is represented by Scott R. Breitenwischer of Royston, Rayzor, Vickery & Williams LLP in Houston.
