Harris Co. man claims baseball used in Kemah Boardwalk game struck him in the face

HOUSTON – Claiming he was struck by a game ball at the Kemah Boardwalk more than a year ago, Harris County resident Yunior Alvarez has filed a lawsuit.

Alvarez’s suit, which was filed on Mar. 5 in the Harris County 127th District Court, implicates Landry’s Crab Shack, Inc. and the boardwalk in the Oct. 22, 2016 incident in question.

Court papers say the plaintiff was playing a game of Down-A-Clown, where the object is to knock down clowns with a baseball. He apparently was next to another Down-A-Clown station with no partition or walls in between.

According to the suit, a baseball thrown by a person at the nearby Down-A-Clown ricocheted and struck the plaintiff in the face.

Alvarez consequently seeks unspecified monetary damages and a jury trial.

He is represented by J. Moises Cedillos of the Cedillos Law Firm, PLLC in Houston.
