HEB Grocery shopper alleges ice patch caused injury

HOUSTON – A Harris County woman alleges she was injured at a Houston grocery store after slipping on a patch of ice.

Kimberly Osterhaut-Arcos filed a complaint on March 5 in the Harris County District Court against HEB Grocery Co. LP alleging negligence.

According to the complaint, the plaintiff alleges that on Jan. 17, 2018, she was injured when she slipped and fell on an ice patch while walking toward the entrance of the defendant's store. She alleges she has incurred pain and suffering, disfigurement, medical expenses and lost wages and earning capacity. 

The plaintiff holds HEB Grocery Co. LP responsible because the defendant allegedly failed to inspect the premises, failed to correct the condition and failed to warn its guests that such a danger existed.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but not more than $1 million and such other necessary relief. She is represented by Jesus A. Salinas and John A. Daspit of Daspit Law Firm in Houston.
