HOUSTON – A certified mobile phlebotomist technician has filed a class-action lawsuit against a company over allegations she was not paid the appropriate rate for overtime work.

Crystal Brown, individually and on behalf of all others similarly situated, filed a complaint on March 8 in the Houston Division of the Southern District of Texas against Reliable Mobile Labs Georgetown LLC alleging that the employer violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she regularly worked over 40 hours per week for defendant but was paid straight time for hours worked over 40.

The plaintiff holds Reliable Mobile Labs Georgetown LLC responsible because the defendant allegedly failed to pay employees at a rate of time-and-one-half of their regular rate for overtime work and also failed to reimburse employees' gas and maintenance on their vehicles used for their employment with defendant.

The plaintiff requests a trial by jury and seeks an order allowing this action to proceed as a collective action, award for all unpaid overtime compensation, liquidated damages, attorneys’ fees and costs, post-judgment interest and such other and further relief. She is represented by Taft L. Foley II of The Foley Law Firm in Houston.
