Life Care Services alleged to have failed to pay overtime wages

HOUSTON – A Fort Bend County woman alleges her former employer implemented a policy that prohibited employees from being paid for overtime work.

Jennifer Cantu, individually and on behalf of all others similarly situated, filed a complaint on March 8 in the Houston Division of the Southern District of Texas against Life Care Services LLV, doing business as The Delaney at Parkway Lakes, and LCS Community Employment LLC alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between May 2017 and February 2018, she regularly worked on an average of 50 to 55 hours a week and was required to be on-call 24/7 to field internet inquiries without receiving overtime pay. 

The plaintiff holds Life Care Services LLV and LCS Community Employment LLC responsible because the defendants allegedly unlawfully implemented a policy prohibiting their employees from claiming any additional hours of work over 40 per workweek and failed to pay overtime work at a rate of time-and-one-half of their regular pay rate.

The plaintiff requests a trial by jury and seeks an order designating this class as a collective action, award for all unpaid overtime compensation, liquidated damages, attorneys’ fees, costs, expenses, pre- and post-judgment interest and such other necessary and appropriate relief. She is represented by Jason A. Richardson and Nicholas R. Lawson of McDowell Hetherington LLP in Houston.
