Individuals allege Penske Trucking Leasing driver ran stop sign, caused collision

HOUSTON – Three individuals are seeking at least $200,000 from Penske Trucking Leasing after their vehicle was struck by the company's driver.

Llionel Dewayne Hart, Dejuan Davis and Damian Harito Neveaux filed a complaint on March 8 in the Harris County District Court against Penske Trucking Leasing Co. LP and Fredrick Lynn Lockett alleging negligent entrustment, negligence and other counts.

According to the complaint, the plaintiffs allege that on Jan. 4, 2017, they were injured when the vehicle they were riding was struck by the vehicle driven by defendant Lockett, who was acting in the course and scope of his employment with defendant Penske. The suit states Lockett failed to stop at a stop sign.

They allege they suffered pain and suffering, mental anguish, medical expenses and other losses and damages. 

The plaintiffs hold Penske Trucking Leasing Co. LP and Lockett responsible because defendant Lockett allegedly failed to stop at the stop sign and failed to keep proper lookout and Penske allegedly failed to properly screen and test its drivers.

The plaintiffs request a trial by jury and seek monetary relief of more than $200,000 but no more than $1 million and such other legal and equitable relief. They are represented by Mark O. Midani and Bridgit Ann White of The Midani Law Firm in Houston.
