Wired Electrical Services alleged to have failed to pay electricians minimum wage

HOUSTON – An electrician has filed a class-action lawsuit against a Harris County company over allegations that he and other employees were denied overtime compensation and minimum wages.

John Losoya, individually and on behalf of all others similarly situated, filed a complaint on March 9 in the Houston Division of the Southern District of Texas against Wired Electrical Services Inc. and Nathanael McCollum alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that during one or more weeks of his employment with defendants between April 2017 and Feb. 14, he worked more than 40 hours per week without receiving overtime compensation and did not receive the then-current minimum wage.

The plaintiff holds Wired Electrical Services Inc. and McCollum responsible because the defendants allegedly failed to compensate their electricians at a rate of no less than one-and-one-half times their regular rates of pay for each hour worked in excess of 40 in a workweek for overtime work.

The plaintiff requests a trial by jury and seeks an order certifying this action as a collective action and appointing plaintiff as class representative and his counsel as class counsel, unpaid wages, liquidated damages, attorneys' fees and costs and such other and further relief. He is represented by Charles L. Scalise and Daniel B. Ross of Ross Law Group in Austin.
