Consumers file fraud suit against OZ Builders

HOUSTON – A La Porte couple alleges a Houston company they hired to build a home failed to complete the project.

Mark Guerrero and Deniese Guerrero filed a complaint on March 15 in the Harris County District Court against OZ Builders LLC and Aaron Ozturk alleging breach of contract, common law fraud and other counts.

According to the complaint, the plaintiffs allege that on July 1, 2016, they entered into a residential construction contract with defendants to construct a new house in lieu of renovating their home. They allege the defendants were unable to complete the project.

The plaintiffs hold OZ Builders LLC and Ozturk responsible because the defendants allegedly falsely represented that they had the professional skill and knowledge to perform their obligations, failed to perform work in a good and workmanlike manner and failed to respond to plaintiffs' demand for refund.

The plaintiffs request a trial by jury and seek monetary relief of more than $100,000 but not more than $200,000 and such other lawful and equitable relief. They are represented by John J. Patout Jr. and Mark Ratway of Germer PLLC in Houston.
