HOUSTON – A Costco shopper is seeking more than $1 million in relief over alleged injuries she suffered when the patio chair she attempted to sit in collapsed and caused her to fall.
Elizabeth Pearson filed a complaint on March 15 in the Harris County District Court against Costco Wholesale Corp. alleging negligence and premises liability.
According to the complaint, the plaintiff alleges that on March 28, 2017, she was injured while shopping at defendant's store located in Houston when the chair she attempting to sit on collapsed underneath her. She alleges she suffered serious injuries that resulted in medical expenses, pain and suffering, mental anguish, disfigurement and loss of earnings.
The plaintiff holds Costco Wholesale Corp. responsible because the defendant allegedly failed to protect the general public from harm and failed to inspect and maintain the area where she was injured.
The plaintiff seeks monetary relief of more than $1 million but less than $5 million and all other relief to which she is entitled. She is represented by Chance A. McMillan and David A. Garcia of Garcia McMillan Law Firm PLLC in Houston.
