Former S. & S. Lumber & Building Co. employee alleges he is owed more than $9,000 in unpaid overtime

LUFKIN – A Nacogdoches man alleges his former Etoile employer owes him thousands in unpaid overtime.

Timoteo Gonzalez filed a complaint on March 16 in the Lufkin Division of the Eastern District of Texas against S. & S. Lumber & Building Co. Inc. alleging violation the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between November 2001 and Feb. 2, 2018, he regularly worked in excess of 40 hours per week for defendant without receiving proper overtime compensation. To date, he alleges the total amount of unpaid overtime wages due to him is no less than $9,457.50. 

The plaintiff holds S. & S. Lumber & Building Co. Inc. responsible because the defendant allegedly failed to compensate him at the rate of no less than one-and-one-half times his regular hourly wages for all overtime hours that he worked.

The plaintiff requests a trial by jury and seeks unpaid overtime wages in the amount no less than $9,457.50, plus an equal amount as liquidated damages, attorney's fees, costs and any other additional relief to which he is entitled. He is represented by Amelia Ruiz Fischer of Fischer & Fischer in Nacogdoches.
