Man alleges Fadi's Franchise breached agreement for restaurant

HOUSTON – A Pasadena man alleges he was damaged after Fadi's Franchise breached an agreement.

Akram Adel Mushtaha MD, et al. filed a complaint on March 22 in the Harris County District Court against Fadi Dimassi and Fadi's Franchise LLC alleging breach of contract, fraud and other counts.

According to the complaint, on March 8, 2016, Mushtaha signed a lease with Baybrook LPC LLC for occupancy of a space for a franchise restaurant with the defendants. The suit states March 23, 2016, Mushtaha received a letter from the defendants' counsel that returned the $40,000 franchise fee he paid to the defendants and stated that the defendants had suspended the project and would not grant the franchise.

The plaintiffs hold Dimassi and Fadi's Franchise LLC responsible because the defendants allegedly failed to perform their contractual duties by refusing to grant a franchise after a location had been approved and secured.

The plaintiffs seek monetary relief of more than $200,000 but not more than $1 million and all other additional and further relief. They are represented by Jeff C. Wigginton Jr. and Kevin C. Navetta of Chamberlain, Hrdlicka, White, Williams & Aughtry PC in Houston.
