Consumer claims Edward Sloan and Associates failed to identify itself as debt collector in voicemails

MARSHALL – A Gilmer consumer alleges a Winnsboro debt collector used deceptive means in an attempt to collect an alleged debt.

Jewell Richards filed a complaint on March 20 in the Marshall Division of the Eastern District of Texas against Edward Sloan and Associates Inc. alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, the defendant called the plaintiff in an attempt to collect a debt within the last year and left voicemail messages that failed to advise the plaintiff that the communication was from a debt collector. She alleges she emailed the defendant Oct. 25, 2017, instructing it to cease calling her but the defendant called after the email was sent.

The plaintiff holds Edward Sloan and Associates Inc. responsible because the defendant allegedly failed to advise her that it is debt collector and continued to make calls even after her request to stop calling her.

The plaintiff requests a trial by jury and seeks actual and punitive damages, statutory damages of $1,000, litigation and attorney’s fees and such other just and proper relief. He is represented by Jenny DeFrancisco of Lemberg Law LLC in Wilton, Connecticut.
